Minor Land Subdivision
Procedure and Land Development Procedure
Preliminary sketch of property to be subdivided
submitted to the Fairview Township Planning Commission five (5) days prior to the meeting
(2nd Monday of each month, 7:30PM) is optional
Developer/land
owner must meet with Planning/Zoning Administrator five (5) working
days prior to the monthly meeting to complete subdivision application,
checklist and pay subdivision fees.

Information in Section C and D is completed by the Sewage Enforcement Officer, Erie County

Fairview Township. The application must be submitted to the Township Municipal
Building with a plot plan (3) days prior to the Supervisors meeting (7th and 21st of
each month 9:00 a.m.). |

Return planning module and
plat plan to Erie County Health Department. |
Township
submits mylar and prints to the Erie County Planning Department for
review.
Mylar
and prints are
submitted to Township for review at the Supervisor's meeting (7th and 21st of each month,
9:00AM).
Property owner to pick up
mylar and remaining prints at the township building for recording at the Erie County
Recorder of Deeds Office. On incorporation, the deposit will be refunded when the
deed is received by the Township. This must be completed within ninety (90) days or
deposit will be forfeited and property owner will be subject to penalties as subscribed by
the Subdivision Ordinance.

Pre-application to preliminary plan to
Fairview Township Planning Commission according to Section 301 of subdivision Ordinance,
to include:
A. General information sheet.
B. Location Map
C. Topographical map (U.S.G.S.)
D. Sketch plan.
Take major or minor planning module
to Erie County Health Department, 606 W. 2nd Street, Erie, PA 16507 (814) 451-6751.

Ten (10) copies of
the preliminary
plan, according to Section 304 of the Subdivision Ordinance, will be
presented to the Fairview Township Planning Commission at their meeting the second Monday of each month. The Township will then
distribute one copy to each of the following:

Upon approval of preliminary
plan and recording , subdivider has five (5) years to submit Final Plan for approval.
Final Plan submitted to Township
Planning and Zoning Administrator, by appointment only, complete with all requirements
according to Section 306 of Subdivision Ordinance, fifteen (15) days prior to the Planning
Commission meeting the second Monday of each month. Final Plan must contain one (1)
mylar and ten (10) prints, ten (10) profile and utility location prints signed and
notarized by the property owner. Township will then distribute one (1) set of Final
Plans to Urban Engineers and County Planning.
Property owner must pay
subdivision deposit on mylar and two (2) prints of $150.00 and a subdivision fee of
$300.00 plus $20.00 per lot: also, a modification fee of $400.00. if required.
Township Planning and
Zoning Administration will submit Plans to the Township Supervisors for final approval at
their regular meeting on the 7th and 21st of each month at 9:00 am.
Property owner to pick up

Upon completion of utility
construction "as built" profiles are to include one (1) mylar and five (5)
prints, must be submitted to the Township.
Rezoning
Procedure
A letter of request for rezoning must be sent to the
Supervisors of Fairview Township, 7471 McCray Road, Fairview, Pa 16415, contains the
following information:
The existing zoning of the property.
The proposed zoning change for the property.
State reason(s) for the rezoning request.
Signature of Property owner(s) must appear on the
letter of request.
A plot plan of the property showing the dimensions of
the area for the rezoning request and location of existing buildings.
A check for
TWO HUNDRED DOLLARS ($200.00) made payable to the Supervisors of Fairview Township.
When ALL the
information listed above is received by the Board of Supervisors at a regular meeting, the
request is forwarded to the Fairview Township Planning Commission and Erie County
Department of Planning for their recommendation.
The Planning Commission considers the request and have
the option to hold a public hearing. If the hearing is held, advertisement with a
legal notice must appear two (2) times in a local paper not less than seven (7) days or
more than thirty (30) days prior to the hearing. The property is posted and property
owners within two hundred (200) foot radius are mailed a copy of the legal notice.
Following the hearing, if held, the Planning
Commission makes a recommendation to the supervisors within 45 days of the hearing.
If no hearing is held,
the Planning Commission makes a recommendation to the supervisors within 45 days of their meeting.
Having received recommendation from the Township
Planning Commission and Erie County Planning, the Supervisors must hold a
public hearing. Advertisement with a legal notice must appear two (2) times in a
local paper not less than seven (7) days or more than thirty (30) days prior to the
hearing. The property is posted and property owners within a two hundred (200) foot
radius are mailed a copy of the legal notice. A decision is rendered within 45 days
of the hearing.
If the rezoning request is granted, a legal description
of the property to be rezoned must be submitted to the township office before the rezoning
is official.
Zoning Hearing Board
Procedure

Apply
for a Zoning Permit in the Planning & Zoning Office.
Incomplete applications will not be accepted.

The Zoning Permit will be denied because in the opinion
of the Zoning Officer, the matter should come before the Zoning
Hearing Board or is an illegal use under the provisions of the
Ordinance.

Complete a Zoning Hearing Board Application for Appeal
in the Planning & Zoning Office. Please remit cash or a check for $250.00
made payable to Fairview Township. The fee is applied to advertising and court stenographer costs.

Zoning
Hearing Board (ZHB) meets the first Tuesday of every month at 7:00
P.M., unless otherwise noted.

The appeal is advertised in the Erie Times two (2)
times, not less than seven (7) days or more than thirty (30) days
before the hearing. Adjacent
property owners within a 200 foot radius are notified and the property
is posted with a copy of the legal notice.

The ZHB has 45 days to render a decision to the applicant.
The applicant
will receive a zoning permit for the request upon payment of required
fees if the request is granted. The
applicant may appeal to the Court of Common Pleas if the request is
denied.
